1. WHAT DATA DO WE COLLECT?

We process your data for the following purposes:

– Taking, at your request, all actions necessary to enter into a contract and to perform the contract: This includes identification data such as first name, last name, residential address, e-mail address, telephone number, as well as any additional information necessary to conclude and perform the contract.

– Marketing and promotion of products offered by Startwin Sp. z o.o.: For this purpose, we process contact data in order to send marketing and promotional information, if you have given your consent.

– Fulfilling any legal obligations incumbent on us: We process data in accordance with legal requirements, such as retaining accounting documents and tax data for a specified period.

– Archival purposes to secure information in case facts need to be demonstrated: Data is stored to secure information in the event of potential legal disputes.

– Possible establishment, assertion, or defense of claims: Data is processed to document and protect legal interests against potential claims.

– For a specific purpose based on your consent to the processing of your personal data: Where processing requires consent, we use the data in accordance with the consent granted.

To enter into a contract, we require that you provide the data indicated in the contract/order form: The required data is specified in the contract or order form.

Additionally, we may ask for optional data that does not affect the conclusion of the contract: Certain additional information may be collected on a voluntary basis; however, failure to provide it will not affect the conclusion of the contract.

3. TO WHOM MAY WE DISCLOSE YOUR PERSONAL DATA?

– Public authorities: We disclose data to public authorities in accordance with applicable laws.

– Entities processing personal data on behalf of Startwin Sp. z o.o.: We cooperate with entities that process personal data on our behalf, based on data processing agreements that have been concluded.

– External data controllers: In certain situations, we disclose personal data to external data controllers, for example legal advisers, attorneys, courier companies, etc.

4. HOW LONG WILL WE STORE YOUR PERSONAL DATA?

For the period necessary to achieve the purposes of processing: Data retention periods depend on the specific purposes of processing and legal requirements.

5. TRANSFER OF DATA TO THIRD COUNTRIES

We do not transfer your data outside Poland, the European Union, and the European Economic Area: Should data be transferred outside these areas, we ensure appropriate data protection safeguards.

You have the right to access the processed data and the right to have it rectified: You may request access to your personal data and request its correction if you find it to be incorrect or outdated.

You may object at any time to the processing of your data: If you object, we will stop processing the data to the extent covered by the objection, unless there are compelling legally justified grounds for further processing.

Providing data is a condition for entering into a contract: Certain data is necessary to conclude a contract; however, providing additional data is voluntary.

9. INFORMATION ON A CHANGE OF PURPOSES OF DATA PROCESSING BY THE CONTROLLER

If the purposes of data processing change, you will be informed: In the event of a change in the purposes of data processing, information will be provided to you in a transparent and understandable manner.

10. CONSENT

If the use of your data is not necessary to perform the contract, comply with a legal obligation, or pursue our legitimate interests, we may ask you to give consent for specific purposes of using your data. Such consent may allow, for example, the disclosure of data to other entities for their promotional campaigns, or automated decision-making based on your data at your request, or telephone/e-mail contact with you in order to provide information on the progress of contract performance. You may withdraw your consent at any time (this will not affect the lawfulness of the use of your data prior to the withdrawal of such consent). Consent is withdrawn by providing appropriate information, in accordance with point (g), item 1 of the section “Right of access and rectification” of this document.

If you consent to the use of your data, the content of that consent will specify the purpose for which we will process the data. Consent for the processing of your data will apply only to purposes for which other legal bases for processing indicated in section 1 points (a)–(e) above do not apply.

The service provider is also the controller of the data of persons subscribed to the newsletter and persons registered for possible webinars.

12. FINAL PROVISIONS

The controller applies technical and organizational measures ensuring the protection of processed personal data appropriate to the threats and the categories of data protected, and in particular secures the data against disclosure to unauthorized persons, being taken by an unauthorized person, processing in breach of applicable regulations, and alteration, loss, damage, or destruction. The controller provides appropriate technical measures preventing unauthorized persons from obtaining and modifying personal data transmitted electronically. In matters not regulated by this Privacy Policy, the provisions of the GDPR and other relevant provisions of Polish law shall apply accordingly.

13. CHANGES TO THE PRIVACY POLICY

The Policy is reviewed on an ongoing basis and updated if necessary. The current version of the Policy was adopted and has been effective as of 1 May 2024.
